Avoiding the Imposition of a Civil Restraining Order

Criminal charges can be severe. You could also face the possibility of a restraining order in the criminal case, which will limit any contact you may have with your family and/or the victim. You could also have a civil restraining order imposed against you.

Following the issuance of a temporary restraining order, a civil hearing will be scheduled within two weeks to determine if a permanent restraining order should be issued. If a civil restraining order is imposed against you, you may not possess a firearm and only the protected party can seek to have the restraining order modified for the first four years. It is essential that you have capable representation in this hearing. Attempting to defend yourself or reason your way out usually produces an adverse result.

I will represent you at this hearing, to protect your rights and contest the imposition of the final order. When it can be helpful I can work with a private investigator who may be able to develop additional evidence in your favor.

If the evidence is such that appears that something really did occur, the question judges always ask themselves in these types of cases is “Will this happen again?” Here, the presentation of mitigating factors may have a beneficial effect on the outcome.
